Abstract
SSO PARTICIPATION is a legal area that is coming under increased scrutiny. The conduct of members in standard setting organizations (“SSOs”) has been the subject of a series of relatively recent lawsuits including federal antitrust actions. In light of the law’s heightened attention on SSOs, this article seeks to highlight considerations that technology developers and their counsel should consider when deciding whether to join SSOs that facilitate technological compatibility and interoperability (as opposed to safety standard organizations).
