As you may recall, Microsoft announced back on September 10 that it had launched a new foundation "as a forum in which open source communities and the software development community can come together with the shared goal of increasing participation in open source community projects." It called it's new non-profit organization the CodePlex Foundation, echoing the name of a commercial site, called CodePlex.com, that it had earlier set up to host open source development projects.
Microsoft launched the CodePlex Foundation with bylaws and other governance documents with which I had some issues, and about which I posted some recommendations. But it also publicly stated that these documents, and the initial boards of directors and advisors, were only temporary. Within 100 days, the statements posted at the site pledged, a new Board would be announced. Nominations for the Boards of Directors and Advisors were welcomed, as well as recommendations on changes to the governance documents.
But December 19 - the 100 day mark - passed quietly, with no announcement of a new Board or a status update on the other goals. So what's up with the CodePlex Foundation, and its pledge to promptly transition into a more independent organization?

Ah yes — "The more things change, the more they stay the same." Isn't that how the old saw goes? Or, in the more impatient parlance of today, simply "Same old, same old." So perhaps it should be no surprise that the old proverb would also hold true in the rough and tumble world of standards. And that is the case, not only generally, but more particularly in the suddenly hot war over eBook reader formats. This time around, though, there are a few new and interesting twists (on which more later).
What's the "same old" part all about? There are two alternate behavioral flavors: (1) try and set a de facto standard that you control, perhaps even obtaining a near monopoly in the process (the "winner takes all" strategy), and (2) pit your standard against another, where your standard gives you some relative, if not absolute, advantages (the "our team vs. their team" strategy).
In this case, it looks like Amazon is attempting to pull off the first, but in fact it's hard to tell whether they are serious, or just adopting a flawed strategy. Either way, I believe they will eventually have to admit defeat.
It's been more than a month since I last wrote about the CodePlex Foundation, the new open source initiative announced by Microsoft in early September. While things were pretty quiet at the Foundation site for some time, that changed on October 21, when the Foundation posted its new Project Acceptance and Operation Guidelines, a key deliverable that gives insight into a variety of aspects of the Foundation's developing purpose and philosophy. Surprisingly, though, there was very little pickup on any of this new information until yesterday (perhaps with a little nudging from the PR side of the house), when several stories popped up on line, including this one, at InternetNews.com, and another at ZDNet.com. Each is based on a conversation between Sam Ramji and the reporter (Sean Michael Kerner, at InternetNews, and Dana Blankenhorn, at ZDNet.com).
In this blog entry, I'll give my impressions of how the CodePlex Foundation is developing, and (as before) my opinions on how effective the decisions being made are likely to be in achieving the Foundation's goals.
They're expected to deal with every new topic that comes down the pike, from regulating securitized credit swaps to beefing up cybersecurity, whether they've had any previous experience with it or not. Of course, there's never a shortage of people who want to educate them, but the "educators" with the greatest access are likely to be lobbyists. And when one paid advocate is promoting one action, political physics dictates that another highly paid individual in somebody else's pocket will be promoting an equal and opposite action. Soon, all potential solutions become obscured by a fog of business propaganda.
Two weeks ago, I wrote a critical analysis of the governance structure of the CodePlex Foundation, a new open source-focused foundation launched by Microsoft.
But what about the business premise for the Foundation itself? Let’s say that Microsoft does restructure CodePlex in such a way as to create a trusted, safe place for work to be done to support the open source software development model. Is there really a need for such an organization, and if so, what needs could such an organization meet?
As with my last piece, I’ll use the Q&A approach to make my points.
Well, it’s been a busy week in Lake Wobegon, hasn’t it? First, the Wall Street Journal broke the story that Microsoft had unwittingly sold 22 patents, not to the Allied Security Trust (which might have resold them to patent trolls), but to the Open Inventions Network. A few days later, perhaps sooner than planned, Microsoft announced the formation of a new non-profit organization, the CodePlex Foundation, with the mission of “enabling the exchange of code and understanding among software companies and open source communities.”
Not surprisingly, more articles were written about the apparent snookering of Microsoft by AST and OIN than about the new Foundation. But while the tale of the 22 patents is now largely over, the CodePlex story is just beginning. Microsoft says that its goal for the new Foundation is to create an open and neutral environment, and that the formation documents posted and governance structure described at the CodePlex Foundation site can provide a foundation for such an organization. The CodePlex site also makes clear that the Bylaws you can find there are just a starter set, stating, “Our governance documents are deliberately sparse, because we expect them to change.”
That’s good to hear, because I’ve reviewed all of the material at the CodePlex site, and I think that quite a bit of the governance structure will need to change before CodePlex can expect to attract broad participation.
Steve Jobs is a genius of design and marketing, but his track record on calling the right balance between utilizing proprietary arts and public resources (like open source and open standards) is more questionable. Two news items caught my eye today that illustrate the delicacy of making choices involving openness for the iPhone platform - both geopolitically as well as technically.
The first item can be found in today's issue of the London Sunday Times, and the second appears at the MacNewsWorld.com Web site. The intersecting points of the two articles are the iPhone and, less obviously, openness. But the types of openness at issue in the two articles are at once both different, and strangely similar.
The Sunday Times piece recounts the (unsuccessful) efforts of Andre Torrez, the chief technology officer at Federated Media in San Francisco, to switch from the iPhone to an Android-based G1 handset, because he objects to the closed environment that the iPhone represents. But after just a week, Torrez reverts to the better app-provisioned iPhone. The Sunday Times author concludes in part as follows:
I'm pleased to report this morning on the formation of a new advocacy group for the use of free and open source software in the U.S. Government. I'm also pleased to have been asked to serve on its Board of Advisors, along other proponents of free and open source software, such as Roger Burkhard, Dawn Meyerriecks, Eben Moglen, Tim O'Reilly, Simon Phipps, Mark Shuttleworth, Michael Tiemann, Bill Vass, and Jim Zemlin.
The new organization is called Open Source for America (OSA), and you can find its Web site here. Tim O'Reilly will officially announce OAS at OSCON later today, and you can find the launch press release here, as well as pasted in at the end of this blog post for archival purposes. I'm sure that you'll also see quite a few articles blossom across the Web today relating to its announcement, but having been in on the planning, here's what it's all about.
Before Linux.com went dark late last year, it was one of the most visited open source news aggregation and discussion sites. As you may recall, word got this March that the Linux Foundation had taken Linux.com over, and was committed to making it bigger, better and richer than before. Further to that goal, it set up "Ideaforge," to tap the developer and user communities to learn what they in an on-line resource to make the Linux ecosystem more successful and satisfying for all involved.
After months of effort behind the scenes, and some pretty impressive Web design, the Linux Foundation delivered on that promise last night. What you'll find there is something that's different from anything that's ever existed before - an interactive, growing, feature and content rich resource that can help you hone your skills, find a job, assemble a Linux-based system, and, of course, access the most up to date news, blogs and ideas about open source software in general, and Linux in particular. What it's all about can be summed up in just six words: For the community, by the community. And if you read this blog, that includes you.
It's said that imitation is the sincerest form of flattery, but I guess being the kind of organization that people love to leak news about might be the next. That seems to be the case with the Linux Foundation, which for the second time in a matter of weeks has seen an enterprising reporter scoop the opposition (and our own internal planning) by releasing a story ahead of our planned schedule. Who knew that an open source foundation could attract paparazzi?
Last time, it was Steven Vaughn-Nichols announcing our acquisition of the Linux.com site, and this time it's the New York Times (no less) announcing a day ahead of time the fact that the Linux Foundation has taken over stewardship of Intel's Linux-based Moblin mobile operating system. If you've been following the mobile space for awhile, this is news worth noting, on which more below.
